KARTIKI NITIN LAWATE RECENTLY, the state government declared that unauthorized constructions built after March 31, 2012 cannot be regularized. Pimpri Chinchwad Municipal Commissioner Shirkar Pardeshi had earlier pointed out that the civic body will be conducting its demolition drive against unauthorized constructions. "We have now found support from the state government from our drive. There is a demand from the elected representatives and citizens for extending the duration of the Gunthewari Act," says Pardeshi. HP spoke to a few developers to got their view on the issue. PREVENTION IS THE WAY TO GO D S Kulkarni, CMD, DS Kulkarni Developers Ltd. says, "The government should implement a strict plan of action which will deter developers from indulging in unauthorized or illegal constructions. At the end, these developers get their money back by selling illegal flats to the common man who has to face the real problem. So, some stringent rules must be set so that no unauthorized construction comes up in the first place." Kulkarni added, "Any construction that is under the prescribed rules but is built without permission can be regularized by paying fees and fines. But if any construction gravely ignores the DC rule, it should be immediately razed. I would say prevention is better than cure. So, the main objective should be to prevent illegal construction from day one so that there will be no unauthorized building in future and no need for demolishing any. People's money will be safe and secure." TIME NO BAR Any illegal construction, regardless of when it was built, should not be permitted to be regularized. "Regularizing illegal construction time and again also gives people the courage to continue building illegally as the authorities are taken for granted. However as per law, if the structure can be regularized, then the owner must be given an opportunity to regularize it," says Rohit Gera, VP - Credai, Pune Metro. Experts point out that small time builders indulge in illegal constructions more often. They rake in money to get more projects. Pardeshi said that they will post the names of such builders on their website to alert people.
