Follow key legal steps to verify real estate documents and ensure a safe, transparent, and hassle-free property purchase.

The most important part of purchasing property are the legalities.  Choosing the right location and the best amenities are also important yet, overseeing the legal aspects can prove to have serious implications. 1. Title verification

The first step is to check if the property is in the seller’s name. Two documents that ensure that the title of the property is clear without ambiguity are:

a. Title deed

The seller should have a clear and marketable title deed to establish the property’s ownership.  

b. Encumbrance certificate

The encumbrance certificate, available at the sub-registrar’s office proves there are no pending legal or financial liabilities on the property. The encumbrance certificate for the last 15 to 30 years should be clear of any liabilities. 2. Property documents

Important documents that the seller must possess are:

a. Sales deed

b. Possession certificate

This is a certificate that proves that the property is in the physical possession of the seller. New residential projects in Pune usually inform buyers when they receive the possession certificate from the authorities.

c. Land tax receipts, and mutation records

The land tax receipts should be paid to date. The mutation records, available at the local municipal office, should confirm that the seller owns the property.

3. Approvals

a. Plan approvals

The local municipality or Panchayat needs to approve the structure plans of residential projects in Pune. A copy of the approval should be obtained from the developer.

b. Zone clearance

Builders in Pune should have zoning clearance from all regulations, like agricultural, forest, residential, commercial, and coastal regulation authorities for their projects for sale.

c. Environment clearance,

Large-scale developments and residential projects should have mandatory environmental clearance.

4. No Objection Certificates

The developer should have the No Objection Certificates from the electricity, water, fire, and pollution departments to comply with the civic regulations.
